Navigating Your Criminal Case with Confidence
Many of our clients are hardworking, contributing members of society who, for one reason or another, find themselves in an unfortunate and frightening situation. Facing the criminal justice system for the first time brings stress, anxiety, and countless questions about the future. How will this affect your job? Your family? Your freedom?
Part of our job as your defense attorneys is to demystify the process. This page answers some of the most common questions we receive from clients across Utah.
About Our Firm & Approach
What types of criminal cases does your firm handle?
Since 1993, we have provided skilled defense against a vast range of state and federal charges. Our primary areas of expertise include DUI/Drunk Driving, Drug & Alcohol Crimes, Domestic Violence, and other Violent Crimes. We also have extensive experience defending clients against charges of theft, fraud, Business Crimes, and issues requiring Professional License Defense.
What makes your law firm different?
Our key advantage is our perspective. We have experience on the other side of criminal cases, including in the prosecutor’s office. This insider knowledge of prosecution tactics gives us a powerful edge in building your strongest defense. We don’t just react to the prosecution; we anticipate their moves.
What areas in Utah do you serve?
Our law offices are located in Midvale, but our team operates in every criminal court in Utah. We regularly protect the rights of clients in Salt Lake City, Provo, Orem, West Valley City, Sandy, and all surrounding communities throughout the Salt Lake Valley and beyond.
Do you only handle criminal law?
While we are renowned for our criminal defense practice, we understand legal challenges extend beyond criminal matters. To provide comprehensive support for our clients, we also offer experienced representation in Bankruptcy, Family Law (Divorce & Custody), Employee Rights, Immigration Law, and Consumer Fraud cases.
The Criminal Defense Process
I've just been arrested. What is the most important thing to do?
The most critical first step is to exercise your right to remain silent and contact an experienced criminal defense attorney immediately. Do not answer questions or try to explain your side of the story to law enforcement without your lawyer present. Anything you say can be used against you.
Should I just plead guilty to get it over with?
Pleading guilty without consulting an attorney is one of the biggest mistakes you can make. A guilty plea creates a permanent criminal record and surrenders your right to challenge the evidence against you. Even if the evidence seems strong, an experienced lawyer may be able to identify defenses, negotiate a reduction in charges (a “plea in abeyance”), or find alternatives to a conviction.
What should I expect from a "free consultation"?
Your free initial consultation is a confidential discussion where you can explain your situation to an experienced attorney. We will listen to the details of your case, provide a preliminary assessment of your legal position, and explain your potential defense options. It’s your opportunity to get answers and decide if our firm is the right fit for you, with no obligation.
Your Rights & The Consequences
How can a criminal charge affect my life?
The consequences can extend far beyond fines or jail time. A conviction can impact your current and future employment, your immigration status, your professional licenses, and your right to own a firearm. Our primary goal is to fight for an outcome that minimizes these long-term consequences and protects your future.
What are my Miranda Rights?
Your Miranda Rights include the right to remain silent and the right to an attorney. Police must inform you of these rights if you are in custody and they are interrogating you. If they fail to do so, any statements you make may be inadmissible in court.
Can a criminal charge be removed from my record?
Yes, in many cases. The legal process for clearing a criminal record in Utah is called expungement. An expungement seals the record of your arrest and conviction from public view. Eligibility depends on the type of offense and the successful completion of your sentence. We can evaluate your case to see if you qualify for an expungement.
