The Criminal Defense Process
I've just been arrested. What is the most important thing to do?
The most critical first step is to exercise your right to remain silent and contact an experienced criminal defense attorney immediately. Do not answer questions or try to explain your side of the story to law enforcement without your lawyer present. Anything you say can be used against you.
Should I just plead guilty to get it over with?
Pleading guilty without consulting an attorney is one of the biggest mistakes you can make. A guilty plea creates a permanent criminal record and surrenders your right to challenge the evidence against you. Even if the evidence seems strong, an experienced lawyer may be able to identify defenses, negotiate a reduction in charges (a “plea in abeyance”), or find alternatives to a conviction.

How can a criminal charge affect my life?
The consequences can extend far beyond fines or jail time. What are my Miranda Rights?
Your Miranda Rights include the right to remain silent and the right to an attorney. Police must inform you of these rights if you are in custody and they are interrogating you. If they fail to do so, any statements you make may be inadmissible in court.
Can a criminal charge be removed from my record?
Yes, in many cases. The legal process for clearing a criminal record in Utah is called expungement. An expungement seals the record of your arrest and conviction from public view. Eligibility depends on the type of offense and the successful completion of your sentence. We can evaluate your case to see if you qualify for an expungement.
